Introduction:

By making a booking and using our van rental services, you (“the renter”) agree to the terms and conditions set forth in this agreement (“Agreement”). Please read this document carefully as it outlines your responsibilities, rights, and limitations when renting from [Your Business Name] (“the Company”).

1. Rental Eligibility

• Age Requirement: All renters and authorized drivers must be at least 25 years old.

• Driver’s License: Renters and additional drivers must present a valid driver’s license, held for at least one year.

• Identification: A valid government-issued ID is required at the time of rental.

• Insurance: Renters must have valid auto insurance that covers rented vehicles or purchase the Company’s insurance at the time of booking.

2. Vehicle Use

• Authorized Drivers: Only individuals listed on the rental agreement as drivers may operate the vehicle.

• Prohibited Uses: The vehicle must not be used for illegal purposes, to tow or push anything, in races, for commercial hire (unless agreed upon), or in hazardous conditions (off-road, flooded areas, etc.).

• Mileage and Fuel: All rentals come with a mileage limit of 150 miles per day. Excess mileage will be charged at a rate of $0.25 per mile. The vehicle must be returned with the same fuel level as when it was rented, or a refueling charge will apply.

• Care of Vehicle: The renter agrees to return the vehicle in the same condition as when it was rented, except for normal wear and tear. Smoking in the vehicle is prohibited.

3. Rental Period and Extensions

• Rental Period: The rental period starts and ends on the dates specified in the rental agreement.

• Extensions: If the renter requires an extension, the Company must be notified at least 12 hours before the original return date. Extensions are subject to availability, and additional fees may apply.

4. Booking, Payments, and Deposits

• Booking Confirmation: All bookings are confirmed only upon receipt of payment and a signed rental agreement.

• Payment: The full rental amount, including any applicable deposits, is due at the time of booking.

• Security Deposit: A refundable security deposit of $500 is required before taking possession of the vehicle. This deposit will be returned within 7 days after the vehicle is returned, provided there are no damages or additional charges.

• Cancellation Policy:

• Cancellations made more than 7 days before the rental start date will receive a full refund.

• Cancellations made 6 days or less before the rental start date will incur a 50% cancellation fee.

5. Damage, Loss, and Insurance

• Damage Responsibility: The renter is responsible for any damage to the vehicle that occurs during the rental period. Any repairs will be deducted from the security deposit, and additional charges may apply if the repair exceeds the deposit amount.

• Loss of Personal Items: The Company is not responsible for any personal belongings left in the vehicle.

• Insurance Coverage: The renter must provide proof of comprehensive and collision insurance that covers rented vehicles or purchase coverage through the Company. If the renter declines insurance, they assume full responsibility for any damage or loss.

6. Breakdown and Roadside Assistance

• Roadside Assistance: The Company offers [24/7] roadside assistance for mechanical issues that arise from normal use of the vehicle. If the vehicle breaks down due to renter negligence (e.g., running out of fuel, keys locked in the vehicle), the renter will be responsible for all costs associated with repairs and towing.

• Mechanical Failures: In the event of a mechanical failure not caused by the renter, the Company will provide a replacement vehicle if available. If no replacement is available, the renter will receive a prorated refund for the unused rental period.

7. Return of Vehicle

• Condition Upon Return: The vehicle must be returned in the same condition as when it was rented. The renter will be charged for any excessive dirt, pet hair, odors, or damage.

• Late Returns: Vehicles returned after the agreed-upon time will be subject to a late fee of $25 per hour, up to a maximum of $500 per day.

• Fuel: If the vehicle is not returned with the same level of fuel, a refueling charge of [X] per gallon will apply.

8. Liability

• Indemnification: The renter agrees to indemnify and hold the Company harmless from any claims, liabilities, damages, or expenses arising from the use of the vehicle during the rental period, including but not limited to injury or death of any persons or damage to property.

• Limit of Liability: The Company is not liable for any indirect, incidental, or consequential damages in connection with the rental, including loss of time or income.

9. Termination of Agreement

• The Company reserves the right to terminate the rental agreement and repossess the vehicle if the renter violates any of the terms and conditions or if the vehicle is used for illegal purposes.

10. Governing Law

• This Agreement shall be governed by the laws of the state of California, without regard to its conflict of laws provisions. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of Los Angeles, California.

11. Privacy Policy

• The Company respects your privacy and will only use your personal information to process your booking and provide services related to your rental. We do not share your information with third parties, except as required by law.

12. Amendments

• The Company reserves the right to modify these terms and conditions at any time. Any changes will be posted on our website and will apply to all bookings made after the changes are posted.

By confirming your booking and making payment, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this Agreement.
